Former Southern Provincial Councilor and former army officer Ajith Prasanna today sought from the Supreme Court a writ order in the nature of co-warranto declaring the disqualification Field Marshal Sarath Fonseka as a Member of Parliament.
The petitioner argues that Fonseka was not a candidate of the UNP and therefore it violated the people's franchise rights to appoint him as a MP of the party.
Fonseka, UNP General Secretary Kabir Hashim, Elections Commission Chairman Mahinda Deshapriya and General Secretary of the Parliament are among the respondents of the case.
The Centre for Policy Alternatives also filed a Fundamental Rights petition against Fonseka's appointment recently. This is the second petition filed with the Supreme Court challenging Fonseka's appointment.
Fonseka was appointed to Parliament through the UNP national list to the position vacated by the demise of former Minister M.K.A.D.S. Gunawardena.
