The Attorney General today filed a revision application against the Gangodawila Magistrate's decision to grant bail to former Additional Magistrate Thilina Gamage over the alleged possession of an elephant calf without a valid license.
The revision application was filed at the Colombo High Court with affidavits of Senior State Counsel Dilipa Peiris and the OIC of the Special Investigations Unit of the CID.
Accordingly, the revision application argues that Gangodawila Magistrate Kanishka Wijeratne applied the Bail Act and granted bail to Gamage, when the Public Properties Act should have been applied.
The Gangodawila Magistrate has not defined the elephant as a public property and has misused the judicial procedure, the revision application further argued.
Gamage was granted bail for alleged possession of an elephant calf without a valid license on June 2. He was released on a cash bail of Rs 500,000 and four sureties of Rs 2.5 million each. He was banned from travelling abroad and was ordered to report to the CID on the last Sunday of each month.
Gamage has been named a suspect for allegedly possessing an elephant calf with no valid license.
The elephant named 'Sakura' was discovered from his residence in early 2015. Its value has been estimated at Rs 6.9 million.
