Attorney-at-Law P. Liyanarachchi today filed a Fundamental Rights petition against the recent public reprimand of a navy officer by the Eastern Province Chief Minister Nazeer Ahamed, requesting the court to make a just and equitable order to restore the dignity and esteem of the navy officer.
The petition also requests an order to restore the dignity and esteem of the school girl involved in the incident.
In addition, the petitioner make order declaring that the fundamental rights of the petitioner guaranteed under Article 12 (1) of the Constitution has been violated by the incident.
The petitioner argues that the incident could have demoralized the armed forces, which could affect the national security. Therefore the fundamental rights of all citizens guaranteed under the constitution could be violated by the action of the CM, the petitioner said.
The petition named the Attorney General, Attorney General representing the President and the Eastern Province CM have been named as respondents.
The petitioner argues that the President failed to take necessary action on the incident as the Commander-in-Chief of the armed forces.
