An appeal has been lodged with the Supreme Court challenging the recent judgment of the Appeals Court concerning State Minister Diana Gamage's parliamentary membership. Social activist Oshala Herath submitted the appeal, asserting that State Minister Gamage is ineligible to hold parliamentary office due to her dual citizenship, including British citizenship.
Herath had previously filed a petition outlining the alleged disqualification of State Minister Gamage, emphasizing her possession of British citizenship alongside her parliamentary role in Sri Lanka. However, the Appeals Court, in a 3-2 split decision on October 31, dismissed the petition with the imposition of a fee.
Undeterred by the Appeals Court ruling, Herath's appeal to the Supreme Court contends that the decision is flawed and seeks a determination that State Minister Gamage lacks the qualifications for parliamentary membership. The appeal names State Minister Gamage and others as respondents, marking a continued legal challenge to address the eligibility concerns raised against the parliamentarian.
