Court of Appeal Delays Verdict on Disqualification Petition Against State Minister Diana Gamage

The Court of Appeal has postponed the delivery of the verdict regarding a petition filed seeking the disqualification of State Minister Diana Gamage's parliamentary seat. The eagerly awaited verdict, initially slated for announcement today before a three-member Appellate Court judge bench, including Court of Appeal President Nissanka Bandula Karunaratne, and Justices Khema Swarnadhipathi and A. Marikkar, will now be disclosed on October 31, 2023.

The petition in question was filed by social activist Oshala Herath, who sought a writ order for the disqualification of State Minister Diana Gamage from holding her parliamentary seat due to her dual citizenship, which includes British citizenship.

The petitioner has raised a vital constitutional point, asserting that, as per the Constitution of Sri Lanka, an individual holding dual citizenship is ineligible to be elected, sit, and vote in the country's Parliament.
