The Colombo Magistrate's Court ordered the expert medical committee tasked with investigating the circumstances surrounding the death of businessman Dinesh Schaffter to explore the facts and provide a clear determination regarding the permissibility of cremation.
The inquiry into this matter was held before Colombo Additional Magistrate Mrs. Rajindra Jayasuriya. Representing the rights and wishes of the deceased's family, President's Counsel Anuja Premaratne conveyed to the court that the final wish of the family was to conduct a cremation for Mr. Schaffter.
In the event that the court orders burial instead, Mr. Premaratne informed the court that the deceased's wife had secured a burial plot in the cemetery belonging to the "Church of England" denomination within the Javawatta public cemetery in Colombo.
Taking these considerations into account, the Colombo Additional Magistrate instructed that affidavits from family members concerning this request should be presented to the court. Furthermore, she emphasized the need to confirm the veracity of the facts presented.
Crucially, the magistrate raised questions about whether the deceased's body is required for any additional investigations and whether cremation is a viable option. These critical inquiries were directed to Professor Asela Mendis, the chairman of the five-member medical committee appointed to investigate the cause of Mr. Schaffter's death.
The Colombo Additional Magistrate revealed that the medical committee had conveyed to the court that reports elucidating the cause of Mr. Schaffter's demise could not be submitted until the body is released. Consequently, the court has sought further clarity on this matter to determine the appropriate course of action in line with the wishes of the deceased's family and the necessity for any potential further investigations.
