Former SJB MP Mujibur Rahman to File Fundamental Rights Petition Seeking Restoration of Parliamentary Seat

Former Samagi Jana Balawehaya (SJB) Member of Parliament, Mujibur Rahman, has announced his intention to file a fundamental rights petition in the Supreme Court of Sri Lanka, seeking the reinstatement of his parliamentary seat.

Rahman's decision comes after he resigned from his position in order to run for the post of Mayor of the Colombo Municipal Council. However, due to the indefinite postponement of the local government election, he now seeks to reclaim his parliamentary seat.

In an interview with a weekly newspaper, Rahman stated that he is in consultation with his legal team to prepare and file the petition. The petition will be directed against several key respondents, including the Elections Commission, the Finance Minister, the Secretary of the Ministry of Finance, and the Attorney General.

Rahman clarified that he stepped down from his parliamentary position after the Elections Commission announced the scheduling of the local government election. His resignation was a prerequisite to contest the mayoral race, and he duly complied by depositing bail as a candidate.

However, with the local government election postponed indefinitely, Rahman finds himself in a unique situation where he is no longer an MP and cannot pursue the intended mayoral candidacy. In light of these circumstances, he is seeking legal recourse to regain his parliamentary seat, arguing that his resignation was contingent upon contesting the election, which is no longer possible.
